Nexus Motion Studios LLC ("Company," "we," "us," or "our") is a Wisconsin limited liability company providing digital media production services to real estate professionals and businesses throughout the United States. This Privacy Policy describes how we collect, use, disclose, retain, and safeguard information obtained through our website at www.nexusmotionstudios.com and through our Services.

By accessing our website, submitting an order, providing contact information, or engaging our Services in any capacity, you acknowledge and expressly consent to the data collection, processing, and disclosure practices described in this Privacy Policy. If you do not consent to these practices, do not use our website or Services.

This Policy is intended to comply with applicable United States federal law and Wisconsin state law, including the Wisconsin Consumer Act and Wis. Stat. § 134.98 (data breach notification). This Policy does not create any rights beyond those expressly stated herein or required by applicable law.

This information may include: full name and business name; email address and phone number (including mobile numbers used for SMS communications); billing address and payment information (processed by third-party payment processors); business address and service jurisdiction; order details, preferences, and communications; photographs, images, and other media files submitted for production; referral information and promotional codes.

Payment data, including credit card numbers, banking information, and billing details, is processed exclusively by third-party payment processors engaged by the Company. The Company does not store, transmit, or have access to complete credit card numbers or full banking credentials.

2.4 Virtual Assistant Processing

Client Materials and related order information may be accessed by Virtual Assistants and independent contractors engaged by the Company to fulfill production Services. VAs are engaged under confidentiality obligations. Client Materials processed by VAs are used solely for production purposes and are not retained or used by VAs beyond the scope of fulfillment.

3. How We Use Your Information

We process information for the following legitimate business purposes: fulfilling contractual service obligations; processing transactions and managing billing; communicating with Clients regarding orders and service updates; sending marketing and promotional communications as authorized by Client consent; improving website functionality and service quality; maintaining system security and preventing fraud; complying with legal and regulatory obligations; enforcing our Terms of Service; and resolving disputes and managing legal claims.

We do not sell personal information to third parties. We do not share personal information with unaffiliated third parties for their own marketing purposes. We do not engage in cross-context behavioral advertising using Client personal information.

4. Marketing Communications and SMS Consent

By submitting an order or providing contact information to the Company, you expressly consent to receive marketing and promotional communications from the Company via email and SMS/text message.

Email Marketing: Marketing emails will clearly identify the Company as the sender and will include a functional unsubscribe mechanism. You may opt out at any time by clicking the unsubscribe link.

SMS/Text Marketing: You consent to receive recurring automated marketing text messages from the Company at the mobile number you provide. Message and data rates may apply. To opt out, reply STOP to any marketing text message. For help, reply HELP.

5. Disclosure of Information

We may disclose Client information only as described herein or as required by law: to service providers engaged under confidentiality obligations; to Virtual Assistants for production purposes; where required by law, court order, or government demand; in connection with a business sale, merger, acquisition, or bankruptcy; and to legal counsel or collection agencies in enforcement proceedings.

6. Cookies and Tracking Technologies

Our website may use cookies, web beacons, pixel tags, and similar tracking technologies to enhance performance, analyze usage, and support marketing activities. You may disable cookies through your browser settings, though doing so may impair website functionality. The Company does not respond to 'Do Not Track' signals at this time.

7. Data Retention

We retain Client information for as long as reasonably necessary to fulfill service obligations, comply with tax and accounting requirements, resolve disputes, and enforce our agreements. Order records and communications are retained for a minimum of seven (7) years. Client Materials may be retained for archival and portfolio purposes unless Client submits a written deletion request.

8. Data Security

We implement commercially reasonable administrative, technical, and organizational safeguards to protect Client information. No security system is completely impenetrable, and the Company cannot guarantee that Client information will never be subject to unauthorized access. In the event of a data security breach, the Company will comply with applicable notification obligations under Wisconsin law, including Wis. Stat. § 134.98.

9. International Operations and VA Data Transfer

The Company may engage Virtual Assistants located outside the United States, including but not limited to the Philippines, India, Eastern Europe, and Latin America. By using our Services, Client consents to the transfer and processing of Client Materials in any jurisdiction in which the Company or its VAs operate.

10. Children's Privacy

Our Services are intended exclusively for business use by adults. We do not knowingly collect personal information from individuals under the age of 18.

11. Business-to-Business Context

The Company primarily provides Services in a business-to-business context. Where Clients submit third-party photographs or property owner information, such Clients remain solely responsible for ensuring their own compliance with applicable privacy and data protection laws.

12. Rights of Wisconsin and U.S. Residents

Residents of Wisconsin and other U.S. states may submit written requests to access, correct, or delete personal information the Company maintains about them. Requests must be submitted in writing to braden@nexusmotionstudios.com with sufficient information to verify identity.

13. No Cross-Context Behavioral Advertising

The Company does not sell personal information and does not engage in cross-context behavioral advertising. Analytics and tracking technologies are used solely for performance measurement, traffic analysis, fraud prevention, and internal business improvement.

Our website may contain links to third-party websites. The Company is not responsible for the privacy practices or content of any third-party website.

The Company's total liability for any data-related claim is limited as set forth in the Terms of Service.
